Agreement to Terms

The following Tommy Gun’s Original Barbershop Gift Card Terms and Conditions (the “Tommy Gun’s Gift Card Agreement”) describe the terms and conditions that apply to the use of any Tommy Gun’s physical gift card (a “Physical Tommy Gun’s Gift Card”) or digital gift card (a “Digital Tommy Gun’s Gift Card”) (each, a “Tommy Gun’s Gift Card” and collectively, the “Tommy Gun’s Gift Cards”).

By purchasing, loading, accepting, or using a Tommy Gun’s Gift Card, you agree to be legally bound by (and to comply with) this Tommy Gun’s Gift Card Agreement. This includes, but is not limited to, conducting transactions electronically and accepting the disclaimer of warranties, damage and remedy exclusions and limitations, binding arbitration, and a choice of law as set out below.

You also agree to be legally bound by (and to comply with) Tommy Gun’s Original Barbershop’s general Terms of Service, applicable Privacy Policy, and any applicable website terms and conditions (collectively, the “Terms of Service”).

This Tommy Gun’s Gift Card Agreement is a binding legal contract between you and Tommy Gun’s Original Barbershop. Please read this Tommy Gun’s Gift Card Agreement carefully before buying, loading, or using a Tommy Gun’s Gift Card. Do not purchase, load, accept, or otherwise use a Tommy Gun’s Gift Card if you do not accept this Tommy Gun’s Gift Card Agreement.

Authorized Use

Physical Tommy Gun’s Gift Cards and Digital Tommy Gun’s Gift Cards may be purchased using valid debit or credit cards and, for Physical Tommy Gun’s Gift Cards purchased in participating locations, cash where available. Available payment methods may be changed by Tommy Gun’s at any time in its sole discretion.

Tommy Gun’s Gift Cards purchased in Canada may only be used in Canada; Tommy Gun’s Gift Cards purchased in the United States may only be used in the United States. A Gift Card can only be used in the country of purchase.

Tommy Gun’s Gift Cards may only be used for authorized purchases of services, retail products, and other eligible items at participating Tommy Gun’s Original Barbershop locations.

Tommy Gun’s Gift Cards:

Cannot be used to purchase other Tommy Gun’s Gift Cards
Cannot be resold or transferred for value (cards resold or transferred for value are void)
Have no cash value and cannot be redeemed for cash except where required by law
Cannot be used to make payment on a credit account

Tommy Gun’s Digital Gift Cards cannot be used online, but only at Tommy Gun’s locations.

For jurisdictions that require cash refunds: certain jurisdictions within Canada and the United States require cash refunds once a gift card balance falls below a specified amount. Where applicable, guests may visit a Participating Location to complete the cash-out process.

Expiration: Tommy Gun’s Gift Cards do not expire. No dormancy or inactivity fees apply.

Except as otherwise required by law, no refunds will be provided on Tommy Gun’s Gift Cards, and Gift Cards may not be returned or cancelled once purchased.

Tommy Gun’s Original Barbershop, its parent companies, subsidiaries, affiliates, franchisees, and service providers, and each of their respective officers, directors, shareholders, employees, representatives, agents, successors, and assigns (collectively, the “Released Parties”) are not responsible for lost, stolen, or damaged Gift Cards or unauthorized use. The value of your Tommy Gun’s Gift Card will not be replaced by Tommy Gun’s or any other Released Party if your Tommy Gun’s Gift Card is lost, stolen or damaged. You should treat your Tommy Gun’s Gift Card like cash and should safeguard your Gift Card number.

Tommy Gun’s Gift Cards may be used as personal or business gifts but may not be used in connection with marketing, advertising, or promotional activities without Tommy Gun’s prior written approval.

You are responsible for any difference between your Gift Card balance and the total purchase amount.

Physical Tommy Gun’s Gift Cards

Physical Tommy Gun’s Gift Cards may be purchased at Participating Locations or through authorized retailers or online platforms.

Physical Gift Cards may carry a maximum load value of $500 as determined by Tommy Gun’s. Reloads may be permitted up to that maximum.

Physical Gift Cards obtained from unauthorized sellers are void.

Balances may be transferred to another Physical Gift Card or Digital Gift Card where supported.

Digital Tommy Gun’s Gift Cards

Digital Tommy Gun’s Gift Cards may be purchased through authorized Tommy Gun’s websites. Tommy Gun’s Digital Gift Cards cannot be used online, but only in Tommy Gun’s locations.

Digital Gift Cards may carry a maximum load value of $500 as determined by Tommy Gun’s.

Balances may be transferred to another Digital Gift Card or Physical Gift Card where supported. Once transferred, the original Digital Gift Card balance will be zero.

Limitation of Liability

THE RELEASED PARTIES MAKE NO WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO TOMMY GUN’S GIFT CARDS, INCLUDING WITHOUT LIMITATION, ANY EXPRESS OR IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. IN THE EVENT THAT A TOMMY GUN’S GIFT CARD IS NON-FUNCTIONAL, YOUR SOLE REMEDY, AND THE RELEASED PARTIES’ SOLE LIABILITY, SHALL BE THE REPLACEMENT OF SUCH TOMMY GUN’S GIFT CARD. CERTAIN PROVINCIAL/TERRITORIAL/STATE LAWS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE DISCLAIMERS, EXCLUSIONS, OR LIMITATIONS MAY NOT APPLY TO YOU, AND YOU MIGHT HAVE ADDITIONAL RIGHTS.

To the maximum extent permitted by applicable law, by buying, loading or using a Tommy Gun’s Gift Card, you hereby: (i) release the Released Parties from any loss, liability, claim, demand, damage or expense that arises in connection with your Tommy Gun’s Gift Card; and (ii) agree to accept all responsibility for, and hereby agree to indemnify, defend and hold harmless the Released Parties from and against any loss, liability, claim, demand, damage or expense asserted by any entity or person relating in any way to your breach of any of this Tommy Gun’s Gift Card Agreement or that may arise from actions taken by you or for any unauthorized access to use or misuse of your Tommy Gun’s Gift Card, a Website or App. Without limiting the generality of the foregoing, the Released Parties are not responsible for: (a) late, lost, misdirected, delayed, incomplete or incompatible Tommy Gun’s Gift Card-related Information; (b) any failure of a Tommy Gun’s Gift Card, Website, the App or any other Tommy Gun’s Gift Card-related software, hardware or other type of system; (c) any technical malfunction or other problems of any nature whatsoever, including, without limitation, those relating to the telephone network or lines, electronic transmission, computer on-line systems, servers, access providers, computer equipment or software, any inability to access a Website, App or other on-line service, the failure of any information to be received, or for any other technical or non-technical error or malfunction; (c) any injury or damage to participant’s or any other person’s computer, mobile device, tablet or other device related to or resulting from the purchase or use of a Tommy Gun’s Gift Card; (d) incorrect or inaccurate transcription of information or any human error or printing error; and/or (e) any combination of the above. Without limiting the foregoing, the Released Parties are not responsible for Tommy Gun’s Gift Cards that are undeliverable, that are not received or that are claimed by someone other than the intended recipient, due to failure to enter an accurate physical address or email address for the recipient at the time of purchase, or due to a recipient’s spam filter, firewall or email capacity.

For Quebec, Canada: To the extent liability in this section is due to the consequences of the Released Parties’ own act, this section will not apply to residents of Quebec.

General Terms

All Tommy Gun’s Gift Card-related information is and remains the sole and exclusive property of Tommy Gun’s. The decisions of Tommy Gun’s with respect to all aspects of this Tommy Gun’s Gift Card Agreement are final and binding without right of appeal.

The collection, use, and disclosure of personal information in connection with Tommy Gun’s Gift Cards is governed by Tommy Gun’s Privacy Policy. By buying, loading, or using a Tommy Gun’s Gift Card, you agree that Tommy Gun’s may collect, use and disclose your personal information to administer and fulfill your Tommy Gun’s Gift Card, including without limitation provide and manage your Tommy Gun’s Gift Card, communicate with you about your Tommy Gun’s Gift Card (including via electronic communications) and otherwise use your personal information with your consent or at your direction, as set out in our applicable Privacy Policy. This section does not limit any other consent(s) that you may provide Tommy Gun’s or others in relation to the collection, use and/or disclosure of their personal information, or alter in any way the terms or conditions of any other agreement you may have with Tommy Gun’s for other products or services.

By using a Website or the App, you acknowledge that technical processing and transmission of the Website or App (as applicable), including the information you may enter, may involve transmissions over various networks and changes to conform and adopt to technical requirements of connecting networks or devices.

The Tommy Gun’s Gift Card program has no predetermined termination date and may continue until such time as Tommy Gun’s decides to terminate the issuance of the Tommy Gun’s Gift Cards. Tommy Gun’s may terminate the issuance of Tommy Gun’s Gift Cards at any time, with or without notice.

Tommy Gun’s reserves the right, to the fullest extent permitted by applicable law and in its sole and absolute discretion, to suspend and/or amend all or any portion of this Tommy Gun’s Gift Card Agreement and any other information relating to Tommy Gun’s Gift Cards at any time and without notice. Any such amendment will be effective immediately upon posting the amended Tommy Gun’s Gift Card Agreement to the applicable Website, and, to the fullest extent permitted by applicable law, you waive any right you may have to receive specific notice of such amendment. Only where required by applicable law or at the Sponsor’s sole discretion, the Sponsor will provide notice of amendment to this Tommy Gun’s Gift Card Agreement, as set out below.

Where required by applicable law or at Tommy Gun’s sole discretion: Tommy Gun’s will provide written notice of a proposed amendment to this Tommy Gun’s Gift Card Agreement at least 30 days (or such longer period as may be required by applicable law) before the amendment comes into effect, using your email address, mailing address, or any other contact information Tommy Gun’s has for you, or by posting written notice to the applicable Website, in Tommy Gun’s discretion. If you do not agree with a proposed amendment, you may cancel a Tommy Gun’s Gift Card purchase prior to its delivery to the recipient or request to return an issued Tommy Gun’s Gift Card for a refund of the remaining balance, at no cost or penalty, by sending Tommy Gun’s a notice to that effect: (a) at any time in the 30 day period prior to the amendment coming into effect; or, (b) if the amendment increases your obligations or decreases Tommy Gun’s obligations under this Tommy Gun’s Gift Card Agreement, no later than 30 days after the amendment comes into effect.

To the fullest extent permitted by applicable law, your continued use of your Tommy Gun’s Gift Card following an amendment, suspension or notice period, as applicable, constitutes your full acceptance of, and agreement to be legally bound by, this Tommy Gun’s Gift Card Agreement as revised. This section shall not limit the Terms of Service, any applicable additional terms incorporated by reference within the Terms of Service, the terms and conditions of the applicable Website, or the terms and conditions of the App (including, without limitation, the right for Tommy Gun’s to make changes to the App or a Website or revise the applicable App or Website terms), which may affect your ability to use your Tommy Gun’s Gift Card.

As a condition of use of a Tommy Gun’s Gift Card, you agree that except where prohibited by law: (a) any and all disputes, claims, and causes of action arising out of or connected with the Tommy Gun’s Gift Card, shall be resolved individually, without resort to any form of class or representative action and exclusively by arbitration, as further detailed below; (b) any and all claims, judgments and rewards shall be limited to actual out-of-pocket costs incurred, including costs associated with purchasing the Tommy Gun’s Gift Card, but in no event legal fees; and (c) under no circumstances will you be permitted to seek recovery for, and you hereby waive any and all rights to claim or seek recovery of punitive, incidental and/or consequential damages, other than for actual out-of-pocket expenses, and waive any and all rights to have damages multiplied or otherwise increased.

Dispute Resolution & Governing Law

Except where prohibited by law, any disputes arising from Gift Cards or this Agreement shall be resolved individually and not through class actions.

For Canada (excluding Quebec), this Agreement is governed by the laws of British Columbia and applicable federal laws of Canada.
For Quebec, this Agreement is governed by the laws of Quebec and applicable federal laws of Canada.
For the United States, this Agreement is governed by the laws of Nevada.

Where permitted, disputes may be subject to binding arbitration.

Severability

If any provision of this Agreement is found unenforceable, the remaining provisions will remain in full force and effect.
