2. Eligibility: Win Free Haircuts for a Year (the "Sweepstakes") is only open to those who sign up at Tommy Gun's Original Barbershop - Best haircuts and grooming products (tommyguns.com). The Sweepstakes is open to legal residents of Canada, excluding Quebec, who are at least 18 years of age at the time of entry, and is void where prohibited by law. Employees, independent contractors, interns, officers, directors, and agents of Tommy Gun's Original Barbershop (the "Sponsor") their respective affiliates, subsidiaries, advertising and promotion agencies, suppliers and their immediate family members and/or those living in the same household of each are not eligible to participate in the Sweepstakes. The Sweepstakes is subject to all applicable federal, Provincial and local laws and regulations. Entrants who do not comply with any of these Rules are subject to disqualification b the Sponsor, in the Sponsor’s sole discretion.
3. Agreement to Rules: By entering the Sweepstakes, the contestant ("You") agree to comply with and abide by these Rules and the decisions of the Sponsor, and you represent and warrant that you meet the eligibility requirements. In addition, you agree to accept the Sponsor's decisions as final and binding as it relates to the content of this campaign. Entrants should look solely to the Sponsor with any questions, comments or issues related to the Sweepstakes.
4. Entry Period: The Sweepstakes begins at on 19 April, 2024 at 12:00AM PDT and ends at on 17 May, 2024 at 12:00AM PST (the "Entry Period"). Entries submitted before or after the Entry Period will not be eligible.
5. How to Enter: The Sweepstakes must be entered by submitting an entry using the online form provided at Tommy Gun's Original Barbershop - Best haircuts and grooming products (tommyguns.com). The entry must fulfil all requirements of the Sweepstakes, as specified, to be eligible to win a prize. Entries that are incomplete or do not adhere to the rules or specifications of the Sweepstakes may be disqualified at the sole discretion of the Sponsor. You must provide the information requested. You may not enter more times than indicated by using multiple email addresses, identities, or devices in an attempt to circumvent the rules. If you use fraudulent methods or otherwise attempt to circumvent the rules of the Sweepstakes, your submission may be disqualified at the sole discretion of the Sponsor. Entrants grant Sponsor a non-exclusive license to use all entries for any purpose.
6. Prizes: The winner(s) of the Sweepstakes (the "Winner") will receive the following prizes:
- 6 Traditional Haircuts at the corresponding Tommy Gun’s Barbershop location the entrant filled out the form (For clarity, the winner will receive a maximum of 6 free haircut which are only usable at the location which the entrant applied and are not to be used at any other Tommy Gun’s Original Barbershop)
Actual/appraised value of prizes may differ at time of prize award. The specifics of the prize shall be solely determined by the Sponsor. No cash or other prize substitution shall be permitted except for at the Sponsor's discretion. Prizes must be accepted as awarded. The prize is non transferable. Substitution of the prize or transfer/assignment of the prize to others or request for the cash equivalent of the prize by the Winner is not permitted. Any and all prize related expenses, including without limitation any and all federal, provincial, and/or local taxes shall be the sole responsibility of the Winner. Acceptance of the prize constitutes permission for the Sponsor to use the Winner’s name, likeness, and entry for purposes of advertising and trade without further compensation, unless prohibited by law.
7. Odds of Winning: The odds of winning depend on the number of eligible entries received.
8. Skill-Testing Question: Selected Entrants will be required, as a condition of winning a prize, to correctly answer, without assistance of any kind, the Sponsor’s time-limited, mathematical skill-testing question.
9. Winner Selection and Notification: Upon the expiry of the Entry Period, the Sponsor, or an employee, agent or other representative of the Sponsor, will conduct a random draw from all eligible entries received before the end of the Entry Period and select the potential winner (“Selected Entrants”) Selected Entrants will be deemed winners if they meet all of the eligibility criteria set out in these Rules. If a Selected Entrant does not meet with eligibility criteria, they will be disqualified and will not receive a prize and another entrant will be selected by way of a random draw from the remaining eligible entries. Before being declared a winner, Selected Entrants will be required to: (1) correctly answer the Sponsor’s skill-testing question; (2) sign and return the Sponsor’s Declaration of Eligibility and Liability/Publicity Release form (“Winner Release”); and (3) comply with all other Rules, all in the sole discretion of the Sponsor.
Selected Entrants will be notified within 7 days of the draw date. The Sponsor shall have no liability for a Selected Entrant's failure to receive notices due to spam, junk e-mail or other security settings or for a Selected Entrant’s provision of incorrect or otherwise non-functioning contact information. If the Selected Entrant cannot be contacted, is ineligible, fails to claim the prize within 7 days from the time award notification was sent, or fails to timely return a completed and executed Sponsor’s Declaration of Eligibility and Liability/Publicity Release as required, the prize may be forfeited and an alternate Selected Entrant will be selected. Receipt of the prize offered in this Campaign by the Selected Entrant is conditioned upon compliance with any and all federal, provincial, and local laws and regulations. Any violation of these official rules by the Selected Entrant at the Sponsor's sole discretion will result in the Selected Entrant's disqualification as winner, all privileges as winner will be immediately terminated, and the Sponsor will select a new Selected Entrant in accordance with this section.
10. Rights Granted by the Entrant: By entering this content (e.g., photo, video, text, etc.), You understand and agree that the Sponsor and anyone acting on behalf of the Sponsor or its respective licensees, successors, and assigns, shall have the right, where permitted by law, to print, publish, broadcast, distribute, and use in any media now known or hereafter developed, in perpetuity and throughout the World, without limitation, your entry, name, portrait, picture, voice, likeness, image, statements about the Sweepstakes, and biographical information for news, publicity, information, trade, advertising, public relations, and promotional purposes without any further compensation, notice, review, or consent. By entering this Sweepstakes, you represent and warrant that your entry is an original work of authorship, and does not violate any third party’s proprietary or intellectual property rights. If your entry infringes upon the intellectual property right of another, you will be disqualified at the sole discretion of the Sponsor. If the content of your entry is claimed to constitute infringement of any proprietary or intellectual proprietary rights of any third party, you shall, at your sole expense, defend or settle against such claims. You shall indemnify, defend, and hold harmless Tommy Gun's Original Barbershop from and against any suit, proceeding, claims, liability, loss, damage, costs or expense, which Tommy Gun's Original Barbershop may incur, suffer, or be required to pay arising out of such infringement or suspected infringement of any third party’s right.
11. Terms and Conditions: The Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Sweepstakes should virus, bug, nonauthorised human intervention, fraud, or other cause beyond the Sponsor’s control corrupt or affect the administration, security, fairness, or proper conduct of the Sweepstakes. In such cases, the Sponsor may select a winner(s) from eligible entries received before and/or after the action taken by the Sponsor if appropriate. The Sponsor reserves the right at its sole discretion to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Sweepstakes or website or violates these Terms & Conditions. The Sponsor has the right, in its sole discretion, to maintain the integrity of the Sweepstakes, to void entries for any reason, including, but not limited to: multiple entries from the same user from different IP addresses; multiple entries from the same computer in excess of that allowed by Sweepstakes rules; or the use of bots, macros, scripts, or other technical means for entering. Any attempt by an entrant to deliberately damage any website or undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil laws. Should such an attempt be made, the Sponsor reserves the right to seek damages to the fullest extent permitted by law.
12. Release and Indemnification: All winners must sign the Sponsor's Winner Release to: (1) confirm compliance with all Rules; (2) agree to accept prizes as awarded; (3) release, discharge and hold harmless the Sponsor, its departments and agencies, parent, related and affiliated companies, subsidiaries, franchisees, advertising and promotional agencies, counsel, marketing partners, and each of their respective directors, officers, employees, shareholders, successors, sponsors, partners, licensees, subsidiaries, agents, artists, advisors, assignees, and all others associated with the administration, development and execution of the Sweepstakes (Released Parties) from any and all manner of action, cause of action, claim or demand, loss or injury, or any suit, debt, covenant, contract, including legal fees and expenses, whatsoever, including but not limited to, claims based on negligence, breach of contract and fundamental breach, failure of any third-party contractor or supplier used in connection with any aspect of the Sweepstakes to perform or deliver any goods or services, or any act of God or any other event beyond the Released Parties' control, any dissatisfaction of any kind by a winner with any aspect of the Sweepstakes or any prize, liability for physical injury, death, or property damage which the entrants, or guests or other third parties, their heirs, successors or assigns have, might have or could have suffered, by reason of or arising out of the entrant's participation in the Sweepstakes and/or in connection with the acceptance and/or exercise by the entrant of prizes as awarded; and (4) indemnify the Released Parties against any loss, damage or expense, including legal fees, that any of the Released Parties may suffer or incur as a result of any non-compliance by entrants with any of these Rules or participation in the Sweepstakes and/or in connection with the acceptance and/or exercise by an entrant, use or misuse of a prize or any travel related thereto.
The Sponsor is not responsible for: (1) incorrect or inaccurate entry information that may affect a person's ability to participate in the Sweepstakes or be awarded a prize, including but not limited to human error, technical malfunctions, lost or delayed entries for any reason, mail failures, omission, or any combination thereof, and entries that fail to fully comply with these Rules; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) lost, incomplete, delayed, mutilated or misdirected entries or Winner Releases; (4) injury or damage to entrants' computers or to any other individual's computer related to or resulting from participating in, or downloading any material regarding the Sweepstakes or accepting a prize; (5) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant's participation in the Sweepstakes or receipt or use or misuse of any prize, including any related travel and the use of entries by Sponsor; (6) the security or privacy of information transmitted via computer networks or for breaches of privacy due to interference by third-party computer hackers or otherwise; or (7) late, lost, misdirected or unsuccessful efforts to notify a potential winner.
13. Intellectual Property: All intellectual property, including but not limited to trademarks, logos, designs, promotional materials, web pages, source codes, images, drawings, illustrations, slogans, and representations are owned by the Sponsor. All rights reserved. Unauthorized copying or use of any of the Sponsor’s intellectual property without express written consent of the Sponsor is strictly prohibited.
14. Disputes: This Sweepstakes is void where prohibited by law and is governed by the laws of Canada. By participating in this Sweepstakes, you agree that any and all disputes that cannot be resolved between the parties, and causes of action arising out of or connected with this Sweepstakes, shall be resolved individually, without resort to any form of class action, exclusively before a court located in Canada having jurisdiction. Further, in any such dispute, under no circumstances shall You be permitted to obtain awards for, and hereby waives all rights to, punitive, incidental, or consequential damages, including reasonable attorney’s fees, other than actual out-of-pocket expenses (i.e. costs associated with entering the Sweepstakes). You further waive all rights to have damages multiplied or increased.
15. Winners List: To request a copy of the winners list please contact the Sponsor. Requests must be sent within four (4) weeks of the end of the Entry Period.
16. The Sweepstakes is in no way sponsored, endorsed, administered by, or associated with Facebook, Twitter, Instagram, Snapchat, YouTube, Reddit, Pinterest, LinkedIn or any other social networks that are used to share the Sweepstakes. You understand that you are providing your information to the owner of the Sweepstakes and not to Facebook, Twitter, Instagram, Snapchat, YouTube, Reddit, Pinterest, LinkedIn or any other social networks.
